What is the TCPA?

The Telephone Consumer Protection Act (TCPA) is a federal law enacted in 1991 aimed at reducing unsolicited telemarketing calls, robocalls, and certain types of text messages. Its main goal is to protect consumers from unwanted communication, while still allowing legitimate calls under specific conditions.

What is telemarketing?

Telemarketing refers to “the initiation of a telephone call or message for the purpose of encouraging the purchase or rental of, or investment in, property, goods, or services, which is transmitted to any person.” However, not all calls fall under this definition. Exceptions include calls made:

  • With the recipient's prior express consent or invitation,

  • To individuals with whom the caller has an established business relationship, or

  • By tax-exempt nonprofit organizations.

  1. Tagging Numbers in the Federal Do Not Call List. To help you avoid potential violations, DealMachine automatically tags any phone numbers listed on the federal Do Not Call (DNC) list. Telemarketing calls to these numbers are against the TCPA regulations unless you have prior express permission from the property owner. This helps you make sure that you are only contacting individuals who are open to communication.

  2. DNC Scrubbing. To automatically remove phone numbers that are in the Do Not Call (DNC) list from your call queue, make sure that the "Scrub DNC" toggle on your Leads tab or Dialer Settings is enabled.   3. Automated TCPA Compliance System. DealMachine uses an automated system that detects potential TCPA violations. Our team reviews every potential violation for further verification. Once reviewed, we will reach out with details on educating our members to ensure compliance with the TCPA regulations.

    Note: While regulations are strictly enforced for calls made to phone numbers on the Do Not Call (DNC) list, the system also monitors for inappropriate behavior, including scammy language, explicit or sexual content, harassment, and other forms of misuse. This ensures that all interactions through DealMachine remain professional and respectful.
